## 1. Agreement

By installing, accessing, or using Namida (the “Software”), you agree to the terms of this End User License Agreement (the “Agreement”).

## 2. License Grant

namidaco grants you a personal, non-exclusive, non-transferable license to use Namida on supported platforms (ex. Android/Windows) for personal use only.

The main project is "source available"; however, it includes certain proprietary or private components that are not covered by the license and remain the intellectual property of namidaco.

## 3. Restrictions

You may **not**:

- Use the Software for any commercial purposes without explicit written permission from namidaco.
- Redistribute, sublicense, or resell the Software, whether modified or unmodified.
- Rebrand or repackage the Software under a different name, company, or license.
- Reverse engineer, decompile, or disassemble the Software **except for personal use only**.
- Use parts of the codebase for purposes other than personal learning or contributing to Namida.

## 4. Ownership and Copyright

The Software and all associated intellectual property rights are owned by namidaco.

- You may read, compile, and modify the source code only for personal usage, or for the purpose of contributing back to Namida.
- Redistribution of the Software under a different name, license, or as part of a commercial product without permission is strictly prohibited.
- Parts of the Software are released under an open source license and may be used according to the terms of that license. However, specific components, packages, or assets may remain proprietary and are not open source. These are clearly marked in the source repository and are subject to additional restrictions as outlined in this Agreement.

## 5. Membership and Payments

Namida may offer an optional membership system that provides access to additional features or benefits. These memberships are voluntary and do not affect the primary functionality of the Software. If any payments are made, they are handled mainly through "Patreon" and are subject to their terms and refund policies.

## 6. Data and Privacy

- Namida does **not** collect any personal data, usage analytics, crashlytics, or background tracking. Your privacy is respected and protected.
- Error Logs are saved locally and can only be shared manually as separate file/s.

## 7. Disclaimer of Warranty

The Software is provided "as is" without any warranty of any kind. To the maximum extent permitted by applicable law, namidaco disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

## 8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall namidaco be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of or inability to use the Software, even if advised of the possibility of such damages.
