6. within the preceding sixty (60) months materially performs, has materially performed, bids for, receives material funding or compensation from, supplies material goods or services to, contracts with, subcontracts for, provides material support to, receives material consideration from, or otherwise undertakes material business for or on behalf of the government, military, defense department, armed forces, intelligence agency, security agency, surveillance agency, law-enforcement agency, national-security body, or defense, military, intelligence, security, surveillance, law-enforcement, or national-security contractor or subcontractor of the United States of America or the State of Israel.

Passive ownership solely through a diversified index fund, mutual fund, exchange-traded fund, custodian, broker, depositary, or other non-controlling passive investment vehicle does not by itself make a person a Restricted Person, unless such arrangement is used to evade this License or is accompanied by actual control, direction, board observer rights, advisory rights, governance rights, technical direction, material influence, or Restricted Use.

"Restricted AI Use" means any of the following acts involving Covered Software, in whole or in part, directly or indirectly:

1. training, fine-tuning, aligning, evaluating, validating, testing, improving, developing, deploying, commercializing, operating, or otherwise using any AI/ML System with, on, using, or in connection with Covered Software;

2. using, copying, accessing, processing, incorporating, transforming, adapting, compiling, analyzing, indexing, embedding, caching, logging, or otherwise exploiting Covered Software for or in connection with any AI/ML System;

3. including, embedding, exposing, providing, reproducing, distributing, transmitting, serving, making available, or otherwise using Covered Software as source code, training material, reference material, retrieval content, prompt content, generated content, product content, product component, service component, dataset, corpus, benchmark, input material, output material, or evaluation material of or for any AI/ML System;

4. submitting, uploading, transmitting, exposing, indexing, embedding, caching, logging, processing, analyzing, inferring on, transforming, or otherwise making Covered Software available to any hosted model, coding assistant, retrieval system, embedding service, evaluation service, data-labeling service, cloud platform, contractor, subcontractor, API provider, or other third-party system or service, whether or not such third party retains, trains on, logs, reviews, caches, or claims not to use the submitted material; or

"Restricted Use" means any Restricted AI Use by a Restricted Person; any Restricted AI Use for, on behalf of, at the known direction or express instruction of, under funding from, under control of, for delivery to, or for the substantial benefit of a Restricted Person, including where a Restricted Person is a known, intended, probable, reasonably foreseeable, or commercially targeted recipient, customer, integration target, acquirer, licensee, user, or beneficiary; any preparatory, enabling, staging, conversion, cleaning, summarization, indexing, embedding, evaluation, or routing act undertaken with knowledge or reason to know that Covered Software will be used in a Restricted AI Use; and any attempt to cause, enable, assist, procure, outsource, route, conceal, or facilitate any such activity.

"Restricted Artifacts" means any dataset, corpus, benchmark, prompt set, retrieval index, embedding, vector database, model, checkpoint, adapter, weight, fine-tune, distillation, evaluation result, synthetic data, generated output, product component, or other artifact created through or for a Restricted Use by, incorporating, trained on, fine-tuned on, evaluated against, prompted with, retrieved from, substantially derived from, or otherwise derived from Covered Software, to the extent such artifact contains, encodes, preserves, reproduces, is substantially derived from, is used as a substitute for expressive content of the Software, or materially preserves, implements, enables, emulates, operationalizes, or extracts protected capabilities, behavior, decision rules, representations, or learned parameters from Covered Software, regardless of human-readable expression.

### 3. Prohibited Uses / 禁止使用

No person may engage in a Restricted Use.

Access, receipt, possession, retention, internal evaluation, internal testing, or internal processing for a Restricted Use is itself a Restricted Use.

No Restricted Person may access, possess, receive, use, copy, modify, merge, publish, distribute, sublicense, sell, host, process, or otherwise exploit Covered Software for any Restricted Use.

Materials that cannot be deleted because of mandatory legal retention duties must be isolated, access-restricted, excluded from all use, processing, training, distribution, commercialization, and product operations, and deleted when the retention duty ends.
