1. DEFINITIONS

  • "Software" refers to the Dhaad Programming Language, including but not limited to:
    • The dhaad_compiler repository, its entire directory structure, and all constituent files.
    • All source code, header files, build scripts, assets (logos, grammar diagrams), documentation, and configuration files.
    • Any derivatives, modifications, or forks of the aforementioned, regardless of the state of modification.
    • Any pre-compiled binaries, packages, or distributions generated from the source code.
  • "Licensor" is Hassan Ali Mohammed Ahmed shoukr9000@gmail.com, the sole owner and copyright holder of the Software.
  • "You" (or "Your") refers to an individual or entity exercising permissions granted by this license.
  • "Use" means to load, execute, display, perform, or otherwise interact with the Software.
  • "Non-Commercial Purpose" means personal, educational, scholarly, or research use that is not intended for or directed towards commercial advantage or monetary compensation. This includes private study, academic research, and evaluation.

2. GRANT OF LICENSE

Subject to the strict terms and conditions of this license, the Licensor hereby grants You a worldwide, royalty-free, non-exclusive, non-transferable, and non-sublicensable license to:

  1. Access and View: You may access and view the source code of the Software.
  2. Use: You may Use the Software solely for Personal, Non-Commercial, Educational, and Study Purposes. This grant is limited to the functional operation of the Software for these explicit purposes.

3. RESTRICTIONS - STRICTLY PROHIBITED CONDUCT

The license granted herein is explicitly limited. You are STRICTLY PROHIBITED from any of the following acts. Any action not expressly permitted is hereby forbidden:

  • A. No Modification: You may not modify, adapt, alter, translate, or create derivative works based upon the Software. This includes but is not limited to forking the repository and making changes.
  • B. No Distribution: You may not distribute, publish, transmit, broadcast, circulate, or share the Software, in source or object code form, with any third party. This includes uploading it to any public repository, website, or file-sharing service.

No Reverse Engineering: You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying ideas, algorithms, or structure of the Software, except to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
  • F. No Commercial Use: You may not use the Software for any commercial purpose whatsoever. Commercial purposes include, but are not limited to:
    • Incorporating the Software into a product or service offered for sale.
    • Using the Software to provide a paid service (e.g., SaaS, consulting, support).
    • Using the Software for internal business operations, productivity, or revenue-generating activities.
    • Any use by a commercial entity.

4. OWNERSHIP & INTELLECTUAL PROPERTY

The Software is licensed, not sold. The Licensor is and shall remain the sole and exclusive owner of all right, title, and interest in and to the Software, including all copyrights, patents, trademarks, trade secrets, and any other intellectual property rights therein. This license does not convey to You any rights of ownership in or to the Software. All rights not expressly granted are reserved by the Licensor.

5. TERMINATION

This license is effective until terminated. Your rights under this license will terminate immediately and automatically without any notice from the Licensor if You fail to comply with any term or condition of this license. Upon termination, You must cease all use of the Software and destroy all copies, full or partial, of the Software in your possession or control.

6. DISCLAIMER OF WARRANTY & LIMITATION OF LIABILITY

6.1. "AS IS" DISCLAIMER. THE SOFTWARE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE LICENSOR EXPLICITLY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

6.2. LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR, ITS REPRESENTATIVES, OR COPYRIGHT HOLDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6.3. JURISDICTIONAL LIMITATIONS. Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages, which means that some of the above disclaimers and limitations may not apply to You. This license gives You specific legal rights, and You may also have other rights which vary from jurisdiction to jurisdiction. The disclaimers and limitations under this license will not apply to the extent prohibited by applicable law.

7. GOVERNING LAW & VENUE

a. Governing Law: This license shall be governed by and construed in accordance with the laws of the jurisdiction in which the Licensee resides or operates its primary business, without regard to its conflict of law provisions. For the purposes of this section, "Licensee" refers to "You" as defined in Section 1.

b. Venue for Disputes: Any legal action or proceeding arising under this license shall be instituted in the competent courts of the jurisdiction where the Licensee is located. The Licensor and Licensee irrevocably submit to the exclusive jurisdiction of such courts.

c. Equitable Relief: The parties acknowledge that a breach of this license may cause irreparable harm for which monetary damages would not be an adequate remedy. Therefore, in addition to any other remedies available, the Licensor shall be entitled to seek injunctive or other equitable relief from any court of competent jurisdiction to prevent or enjoin such a breach.
